Before You Walk In
When parents disagree about custody or visitation, California requires mediation before the court hears the issue (Family Code 3170). Many parents walk into mediation unprepared. That's a missed opportunity, because mediation often shapes the outcome of the whole case.
Here's how I help parents prepare:
1. Know your goals. Write down the schedule you want and why it works for your child.
2. Draft a proposed parenting plan. Cover weekdays, weekends, holidays, summer, exchanges and communication.
3. Think about the other parent's likely position. Where could you compromise without hurting your child?
4. Gather key information. School schedules, work schedules, the child's activities and any safety concerns.
5. Complete any required orientation. Many counties require an online or in-person orientation first.
Most importantly, prepare yourself to stay calm. Mediators notice which parent is focused on the child and which is focused on the conflict.
If there's a history of domestic violence, tell the court before mediation. You may be able to meet with the mediator separately.
